After so much ecosystemic pushback and problem denial (even by the regulator!?!), the market is finally moving

The Hanover case of May this year crystalised the problem of towels on loungers in the travel and accommodation industry; what "makes or breaks" the whole experience
How?
The court in Hanover labelled the product as "defective", calling out the product in the claim made, not the person making the claim. The claimant was asserting their rights as a consumer and this problem has been unsolved for WAY too long. We all know what it is as defined in the claim (it's all over our social media) and following the similar claim of 2024, the ~doubled award from the court between then and now opened up the floodgates for copycat claims for customers who'd literally had enough of the ritual of having to get up early...on their well-earned holiday. It may have triggered legal firms to spin up too to cash in. Dieselgate II
The domain is a mess and ripe for disruption
But the floodgates weren't opened up just on the basis of unoccupied loungers and abandoned towels and 15% refunds
Advances in technology meant that other long-buried and denied risks surfaced too...and in a big way
Clause 4 Bidewell v ICO and Cabinet Office at FTT GRC issued in October 2025 but backdatable to 2017 confirmed that everyone has a fundamental human right under such Articles as 2.1 ICCPR 1966, 30 CRPD 2008 and similar instruments to be able to access the lounger in demonstrably exactly the same amount of time as everyone else in the first place and called out the importance of inclusive experiential design in the anticipation required by the legislation - claims for indirect discrimination potentially command a higher premium for settlement then merely abandoned towels

We're now into the land of false representation, being led to believe something to be true and fair when on closer (resisted, we've seen a lot of that) inspection, it perhaps isn't and the land of double materiality, sustainable finance and development and impact at scale in perhaps different dimensions, levels, scale and measures of success that we were looking at previously

- IP distributors and agents - possibly advisory firms and similar
- Investors in the proptech, tech4good and impact at scale areas who can see the opportunity, open doors and get stuff done for where we currently are on the journey; and have been for WAY too long
