The Division

The Housing and Regeneration team is one of the largest in the country, and advises on all types of development transactions—from forward funded schemes, s106 acquisitions, golden brick transactions, land led schemes, options/conditional contracts, overage provisions and large scale estate regeneration schemes, and stock rationalisations to general asset management work. It also has a very successful housing management department supporting housing associations with landlord/tenant matters.

The Role

We are seeking a self-motivated and committed Associate (2 years+ PQE) to join our team working on matters primarily with a commercial property focus, but a background in working on development projects would be useful too. The Associate will join the real estate investment team sitting within the Housing and Regeneration Division in our London office.

The main duties will be to:

  • Manage an existing commercial property caseload on behalf of housing clients including the following main duties:
    • Providing fixed fee estimates to housing clients for all commercial property matters in line with agreed fees under Frameworks or existing fixed fee agreements;
    • Commenting upon heads of terms and other commercial arrangements prior to receiving instructions to act;
    • Drafting and negotiating commercial property agreements including agreements for leases, leases and licences, deeds of easement, surrender and variation, acting for either Landlord or Tenant as the matter requires.
    • Providing portfolio lease reviews for housing clients as required.
    • Liaising with the firm’s property litigation team to make appropriate referrals, such as for service of Notices, Landlord and Tenant disputes and collection of rent arrears.
    • Receiving referrals from the property litigation team in respect of commercial property asset management.
    • Supporting the Development Team in relation to commercial property units associated with new development schemes.
    • Work alongside the Commercial Team to fulfill client’s leasing requirements in relation to care homes and supported living, dealing with the interaction between leases and management agreements and service level agreements and nominations agreements.
    • Dealing with all transactional aspects of the freehold sale and acquisition of commercial premises.
    • Dealing with Electronic Communications Code agreements for housing clients as tenants.
    • Work with the firm’s property litigation team to provide a training programme to housing clients on commercial lease management.
    • Provide support to the charging team as required.
    • Participate in other appropriate commercial property business development initiatives.
    • Record time, bill clients and manage debt in line with agreed targets; re-estimate for matters outside of fixed fee scales.
    • Support the real estate investment team with acquisitions and asset management matters on behalf of developers, investment funds and housing providers, with a particular focus on commercial property work.

In this regard the main duties will be to:

  • Investigate title and report to clients;
  • Acquire sites / land / properties for the purpose of providing housing and/or education including setting up related lease structures to ensure the client’s objectives are achieved;
  • Deal with complicated title, planning and estate management issues and leasehold projects;
  • Work closely with our planning, construction, procurement and other teams to ensure that the client’s objectives are achieved;
  • Provide technical support to paralegals to ensure that clients' service deadlines for exchanges are met;
  • Establish strong relationships with the team's clients, deliver training to clients and internally to team members, and provide support to the rest of the real estate investment team; and
  • Contribute to the team’s active business development.

Skill Set

The successful candidate is likely to have previous experience within a commercial property, development, real estate or generalist property profession in legal or professional services and will be able to demonstrate experience in these areas.

Knowledge and experience that would be beneficial for this role includes:

  • Familiarity with Part II of the Landlord and Tenant Act 1954;
  • Experience in property - both leasehold and freehold including investigation of title and reporting work and the acquisition of sites for development;
  • Knowledge and understanding of affordable housing products, regulation and procedures; and
  • Knowledge of the housing sector, including the HE grant programme requirements and particular contractual structures to enable development of affordable homes by registered providers of housing for rent, shared ownership or outright sale.
