Senior Associate (5+ PQE) – Court of Protection and Contentious Private Client Disputes

About the Role
At B P Collins LLP, we specialise in advising individuals, families, deputies, attorneys, and executors on complex and sensitive disputes involving mental capacity, vulnerable individuals, trusts, and estates.
Our work includes disputes relating to:

- Matters overlapping with contentious probate and private wealth disputes

We currently seek a Senior Associate (5+ years post-qualification experience) to supplement our expanding contentious private client practice, particularly in Court of Protection disputes. This is a strategic role designed to enhance our team’s ability to handle complex litigation while upholding high standards of client care.
Key Responsibilities
Client Representation & Case Management
- Lead a varied caseload of contentious probate, Court of Protection, and private client disputes, from initial instruction through to resolution.
- Handle high-profile client matters relating to:
- Court of Protection disputes (property/financial affairs)
- Deputyship and attorney disputes
- Mental capacity (under the Mental Capacity Act)
- Financial abuse and safeguarding concerns
- Removal/replacement of deputies/attorneys
- Disputes over decision-making for vulnerable individuals/families
- Manage both direct negotiations, mediations, and formal court proceedings (including litigations proceedings).

Mentorship & Practice Development
- Advise clients strategically from early-stage, offering practical guidance to ensure high standards of health, performance, and sustainability.
- Supervise and mentor junior team members, fostering professional development in a collaborative environment.
- Collaborate across Private Client and Dispute Resolution teams and support the expansion of the Court of Protection capability.
Business Development & Client Care
- Build and maintain strong relationships with families, individuals, medical professionals, counsel, and other key advisers.
- Participate in client relationship management and business development, contributing to future practice growth.
About You
We are looking for a seasoned solicitor, ideally experienced in contentious probate, with a track record in:
- Court of Protection disputes (preferably appearance before the Court).
- Financial abuse/safeguarding issues and mental capacity litigation.
- Managed caseloads independently with minimal supervision.
- Demonstrated client communication skills, particularly in highly sensitive contexts.
Desired attributes include:
- Strong technical capability combined with emotional intelligence.
- Prudent dispute resolution strategies (negotiation, mediation, litigation).
- Experience or eagerness to contribute to practice routinely mentoring associates/senior-associates.
