The client is a boutique firm based in Central London, whose Court of Protection team has extensive experience handling a wide range of complex cases and is recognised by Chambers and the Legal 500 as thought leaders for the sector. As a leading Legal 500 firm, it takes pride in providing a high level of client care, representing individuals, often vulnerable adults, in relation to their property, financial affairs and health and welfare decisions under the Mental Capacity Act 2005, with many clients holding ongoing personal injury or clinical negligence claims resulting in multi-million-pound awards.
Court of Protection Solicitor — Position Overview
Advise and represent clients on a range of complex Court of Protection matters
- Act in the best interests of vulnerable clients, often liaising with families, carers, local authorities and healthcare professionals
- Work with brain-injured and vulnerable clients on property, financial affairs and health and welfare decisions
- Manage sensitive matters with professionalism and empathy

Key Responsibilities of the Court of Protection Solicitor
- Advising clients, families and carers on issues relating to mental capacity and the Court of Protection process
- Making applications to the Court of Protection, including for the appointment of deputies, statutory wills and complex financial or health decisions
- Acting as a professional deputy or supporting lay deputies in managing a client's property and affairs
- Managing Property and Affairs Deputyships, trust management, tax affairs and accounts, and drafting Personal Injury Trusts, Statutory Wills and Welfare Deputyship applications
- Handling disputes relating to the Court of Protection, including capacity challenges and objections to health and welfare decisions
- Preparing and reviewing Lasting Powers of Attorney and advising on their use and registration
- Liaising with healthcare professionals, social services and other stakeholders, and maintaining accurate records in compliance with SRA standards
Requirements of the Court of Protection Solicitor
- Qualified Solicitor with experience handling complex Court of Protection matters
- Strong analytical and financial skills with a keen eye for detail
- The ability to manage sensitive matters with professionalism and empathy
- Experience working with vulnerable clients and liaising with families, carers and healthcare professionals
- Excellent client care and communication skills
- A sound understanding of the Mental Capacity Act 2005 and Court of Protection practice
