We're partnered with a specialist insurer underwriting title and legal indemnity risks across Europe. They have a reputation for innovative, bespoke products in a corner of the market that still rewards original thinking - as the business continues to grow, they are looking to appoint a Senior Underwriter to lead on right to light risks.
Right to light remains one of the most consequential legal risks in property development. Planning consent does not override a neighbour's easement of light, and an injunction remains a live remedy, up to and including cutting back part of a completed building. As a result, insurance has become the backstop of most serious development risk strategies. It typically sits alongside specialist light surveys, negotiated releases and settlement strategy, and recent case law on proportionality and damages has kept the area technically lively.

You will underwrite right to light risks on development schemes, from single sites to major urban projects. That means assessing light surveys, scheme design and the likelihood and quantum of claims, then structuring cover for legal costs, compensation settlements, abortive design and construction costs and loss in land value. You'll work closely with brokers, developers' counsel and rights of light surveyors, build the book through your own market relationships, and help shape new product as the proposition grows across Europe.
We're keen to speak with underwriters or brokers from the legal indemnity or real estate insurance market with genuine right to light exposure, and equally with real estate or property litigation lawyers who have strong right to light experience gained advising developers, landowners or neighbouring owners.
