This document sets out the Terms on which Lightning Riders Limited, UK registered company 13514853 (‘Lightning Riders’, ‘We/Us/Our’), provides access to the Rodeo mobile application (‘Rodeo’) to you (‘User’, ‘You/Your’). By downloading and using Rodeo you agree to adhere and be bound by these Terms.

The Rodeo App
Rodeo is a mobile application created and owned by Lightning Riders to help delivery riders carry out their business.
The Rodeo app provides Users with information and insights that may be useful to them in carrying out their business. The objective of Rodeo is to help to improve the earnings of delivery riders.
The Rodeo app is provided to Users for free. We do not make any commitments to the User about the quality, accuracy or usefulness or information provided in the Rodeo app. We reserve the right to withdraw the Rodeo App at any time.
Rodeo has not been developed to meet your individual requirements. Please check that Rodeo’s facilities and functions (as described on the App Store or Play Store site) meet your requirements before proceeding to use the app.
Permitted use of Rodeo
The Rodeo app enables Users to:
Create a Profile on the Rodeo app.
Request and retrieve their historic earnings data from selected platforms for which they work as a delivery rider. For example, a User who works for Delvieroo or UberEats can use the Rodeo app to access their historic ride data.
Receive analysis about their performance data. The Rodeo app provides analysis regarding a User’s performance. If and how the User interprets or uses this analysis is entirely at the discretion of the User.
Receive insights about the market for delivery riders. The Rodeo app will from time to time share insights about pricing, demand levels or other conditions in the overall delivery rider market.
Post comments and other content about their experience as a delivery rider that will be seen by other Users. For example, if a User has a positive or negative experience while collecting a delivery they may wish to share this with other Users.
See comments and other content left by other Users. If and how a User chooses to use the information provided by other Users is entirely up to the User. Lightning Riders cannot verify the accuracy of any information provided by Users.
You may download or stream and view a copy of Rodeo onto your Apple or android device for your personal purposes only.
You must be 18 years’ old to use Rodeo.
Prohibited use of Rodeo
Users must not have more than one Rodeo profile.
Users must only retrieve earnings data from platform accounts for which they are the legal owner. It is prohibited to use or attempt to use Rodeo to access platform accounts for which you are not the owner.
Users must not share access to their Rodeo profile with anyone else. It is prohibited to rent, lease, sub-license, loan, provide, or otherwise make Rodeo available in any form, in whole or in part to any person without prior written consent from us.
Users must not share any content which is offensive, unlawful, discriminatory, fraudulent, intentionally misleading or otherwise harmful. Anyone who believes that any content on Rodeo is incorrect or breaches these terms, is encouraged to report this as soon as possible to our customer service team at hello@gorodeo.app.
If you breach any of these terms, we may take action to remedy the situation including:
removing the content shared in breach of the terms
temporarily or permanently remove or restrict your access to Rodeo.
Access to the Rodeo app
We reserve the right to remove the access to the Rodeo app for any User at any time.
If you download or stream Rodeo onto any phone or other device not owned by you, you must have the owner's permission to do so. You will be responsible for complying with these terms, whether or not you own the phone or other device.
User privacy
We take the privacy of Users extremely seriously. Rodeo’s aim is to help Users take control of their own data because we believe in a transparent and fair market for delivery riders.
The Rodeo Privacy Policy sets out in detail the ways in which we protect Users’ data and the rights of the User to access, control or delete their data.
We will never sell your personal data or share it without your explicit consent. We only use any personal data we collect through your use of Rodeo in the ways set out in our Privacy Policy.
Changes to Rodeo and these terms
From time to time we may automatically update Rodeo to improve performance, enhance functionality, reflect changes to the operating system or address security issues. We may also ask you to update Rodeo to complete installation of any updates.
If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using Rodeo.
We may need to change these terms to reflect changes in law or best practice or to deal with additional features which we introduce. We will give you at least 7 days’ notice of any change by sending you an SMS, email or notification with details of the change or notifying you of a change when you next start Rodeo.
If you do not accept the notified changes you may continue to use Rodeo in accordance with the existing terms but certain new features may not be available to you.
Copyright and content
All intellectual property rights in Rodeo and in any material published on it throughout the world belong to us. You have no intellectual property rights in, or to, Rodeo other than the right to use Rodeo in accordance with these terms.
You may only make copies of any extracts of information on Rodeo for your own personal use or to draw the attention of others to content posted on our site. Our status (and that of any identified contributors) as the creators of any content on our site must always be acknowledged (except where the content is user-generated).
You must not use any content on Rodeo for commercial purposes, nor must you modify any copies of Rodeo content (paper or digital).
If you print, copy, download, share or repost any information from Rodeo in breach of these terms of use, we may suspend and/or remove your access to Rodeo and you must, at our option, return or destroy any copies you have made.
When you upload or post content to Rodeo, you grant us the following rights to use that content:
a worldwide, non-exclusive, royalty-free, transferable licence to use reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by Rodeo and across different media including to promote the site or the service to expire when the user or Rodeo deletes the content; and
a worldwide, non-exclusive, royalty-free, transferable licence for other users to use the content in accordance with the functionality of Rodeo, to expire when the user or Rodeo deletes the content.
Limitations of liability
Rodeo will include information and materials uploaded by other users, although any such information and materials do not necessarily represent our views or values. If you wish to complain about content uploaded or comments made by other users, please contact us at hello@gorodeo.app.
Rodeo helps you to access data from other apps and relies on the accuracy of that data. We are not responsible for the accuracy of any data accessed from another app or company.
Rodeo may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any). You will need to make your own independent judgement about whether to use the sites you visit using links on Rodeo, including whether to buy any products or services offered by them.
We are not responsible for any unforeseeable loss or damage and/or damage due to any failure to use reasonable care and skill.
If defective digital content that we have supplied damages a device or digital content belonging to you, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
We are not liable for business losses. Rodeo is for the private use of individual riders. If you use Rodeo for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, loss of anticipated savings, loss of business opportunity, goodwill or reputation, business interruption, loss of business opportunity or any indirect or consequential loss or damage.
You agree to indemnify us in respect of any losses, costs or other sums incurred in the event that any material you post on Rodeo leads to us incurring any losses, costs or other sums.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
Legal
This agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay in enforcing these terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your any breach of these terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
The ways in which you can use Rodeo may also be controlled by your operating system’s rules and policies and, depending on your operating system, either Apple’s or the Play Store’s rules and policies will apply instead of these terms where there are differences between the two.
We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
These terms are governed by English law. The English courts will have exclusive jurisdiction over any dispute arising from or related to your use of the products.
